Terms of Service

These Terms of Service (the Terms) apply to the SaaS Growth theme, its included templates, modules, sections, assets, documentation, updates, and related support (together, the Theme) provided by Trancekode Infoway (Trancekode, we, us, or our). By purchasing, downloading, installing, or using the Theme, you agree to these Terms.

1. Eligibility and authority

You must be legally able to enter into these Terms. If you use the Theme for an organization or client, you confirm that you have authority to act for that organization or client and that they will comply with these Terms.

2. Marketplace purchase and account requirements

The Theme is distributed through the HubSpot Marketplace. Your purchase, payment, billing, refunds, and access through the Marketplace may also be governed by HubSpot's applicable terms and marketplace processes. You are responsible for maintaining a compatible HubSpot account, suitable subscription, permissions, and any third-party services needed for the features you choose to use.

3. License to use the Theme

Subject to payment of applicable fees and compliance with these Terms, we grant you a non-exclusive, non-transferable license to install, use, and customize the Theme for the HubSpot account, websites, and permitted use covered by your Marketplace purchase. You may allow your employees and contractors to work with the Theme for that permitted use, provided they follow these Terms.

You may not resell, sublicense, redistribute, publish, or make the Theme's source files available as a standalone product or competing theme. You may not remove proprietary notices, claim the unmodified Theme as your own product, or use the Theme in a way that infringes another party's rights.

4. Your content and customizations

You retain ownership of the copy, images, data, branding, code, and other materials you add to the Theme. You are responsible for the accuracy, legality, accessibility, privacy compliance, licensing, and rights associated with that content and with any custom code or third-party service you add.

5. Included features and compatibility

The Theme is designed for HubSpot Content Hub and includes the templates, modules, sections, and settings described in its current Marketplace listing and documentation. Some HubSpot functions, including native CTAs, HubSpot-hosted video, and site search, require an eligible paid HubSpot subscription. Browser, platform, and HubSpot changes may affect compatibility, and not every third-party script or customization can be supported.

6. Support

Standard support covers reasonable installation and configuration guidance, clarification of included functionality, and reproducible defects in the unmodified Theme. Unless agreed separately in writing, support does not include content entry, migration, custom development, custom design, search optimization, analytics configuration, third-party integrations, or issues caused by modified code, external scripts, unsupported browsers, or HubSpot account settings.

To help us investigate, provide your HubSpot account ID, affected page URL, template or module name, steps to reproduce, screenshots, and browser/device details. Do not send passwords, private customer data, or access tokens.

7. Updates

We may release fixes, compatibility updates, and improvements through HubSpot. Updates may modify or remove obsolete behavior when reasonably necessary for security, platform compatibility, or product quality. You are responsible for reviewing updates and testing customizations before applying changes to a production site.

8. Acceptable use

You may not use the Theme to violate law, distribute malware, gain unauthorized access, interfere with HubSpot or another service, infringe intellectual property or privacy rights, or create deceptive, abusive, or unlawful content.

9. Third-party services and materials

The Theme may display or connect to HubSpot features, fonts, media, icons, forms, menus, integrations, or other third-party services. Those services are controlled by their respective providers and governed by their own terms and privacy policies. Demo names, logos, images, testimonials, statistics, and links are illustrative and must be replaced or properly licensed before you publish your site.

10. Intellectual property

Trancekode and its licensors retain all rights in the Theme other than the limited license granted above. The Theme, its original design system, source code, documentation, and branding are protected by applicable intellectual property laws. HubSpot and third-party names and trademarks belong to their respective owners.

11. Disclaimers

To the maximum extent permitted by law, the Theme and support are provided on an “as is” and “as available” basis. We do not warrant that every design, feature, integration, browser, customization, or business outcome will meet your requirements, or that operation will always be uninterrupted or error-free. You are responsible for previewing, testing, backing up, and approving your website before publication.

12. Limitation of liability

To the maximum extent permitted by law, Trancekode will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from the Theme. Trancekode's total liability relating to the Theme will not exceed the amount you paid for the Theme during the twelve months before the event giving rise to the claim. These limits do not apply where applicable law does not permit them.

13. Suspension and termination

Your license ends if you materially breach these Terms and do not cure the breach after reasonable notice where a cure is possible. On termination, you must stop new use and distribution of the Theme and comply with any Marketplace requirements that apply. Sections intended by their nature to survive termination, including ownership, disclaimers, liability limits, and dispute terms, will survive.

14. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to any mandatory rights or dispute process that applies to you, courts located in Ahmedabad, Gujarat, will have exclusive jurisdiction over disputes arising from these Terms.

15. Changes to these Terms

We may update these Terms to reflect changes to the Theme, HubSpot requirements, our practices, or applicable law. We will post the revised version on this page and update the date above. Material changes apply prospectively unless law requires otherwise.
